1. Parties
These Terms of Service (the "Terms") govern your access to and use of Trigvale (the "Service"), provided by:

By creating an account or otherwise using the Service you accept these Terms and our Privacy Policy. If you do not accept them, do not use the Service.
2. What the Service is — and is not
Trigvale is a structured idea-validation tool for solo founders. It scores ideas against an opinionated rubric, pulls live market evidence from public APIs, calibrates the result against your declared founder profile, and emits a verdict (kill / pivot / test / build) together with a reasoned brief.
The Service is decision support, not a guarantee. A "Build" verdict is not a prediction of commercial success; a "Kill" verdict is not a prediction of commercial failure. The Service does not provide legal, tax, financial, investment, medical, or other professional advice. All decisions about your business or projects remain entirely yours.
3. Eligibility and accounts
You must be at least 16 years old to use the Service. If you use the Service on behalf of a legal entity you represent and warrant that you are authorised to bind that entity. You agree to provide accurate registration information, to keep it current, and to keep your authentication credentials secure. You are responsible for all activity under your account.
4. Subscriptions, billing, and right of withdrawal
Free, Starter, Pro, and Operator plans are described on /pricing. Paid plans are billed in advance on a monthly cycle by our payment processor (Stripe Payments Europe Ltd.). Subscriptions renew automatically until cancelled.
Cancellation. You can cancel at any time from Settings. Cancellation prevents the next renewal; you retain access until the end of the current paid period. Except as required by law, fees already paid are non-refundable.
Right of withdrawal (consumers in the EU). If you are a consumer within the meaning of §13 BGB you have a statutory 14-day right of withdrawal under §§ 312g, 355 BGB. By placing a paid order and ticking the consent checkbox at checkout you expressly request that performance of the digital service begins immediately and acknowledge that, in accordance with §356(5) BGB, your right of withdrawal lapses once we have begun providing the digital content with your consent and you have confirmed your awareness of the loss of the right of withdrawal. Until you have ticked that checkbox the right of withdrawal remains available.
Price changes.We may change prices for future billing cycles with at least 30 days' notice by email. If you do not accept the new price you may cancel before the next renewal; continued use after the new price takes effect constitutes acceptance.
VAT. Prices on the pricing page are exclusive of value-added tax; applicable VAT is added at checkout and shown on the Stripe invoice.
5. Quotas and fair use
Each plan includes a monthly quota of evaluations, sharpens, and sprint generations as published on the pricing page. Quotas reset on the first calendar day of each month. Sustained automated usage that materially exceeds the published quotas — for example via API tokens beyond their tier — may be rate-limited or temporarily suspended. We will notify you before any suspension for fair-use reasons.
6. Acceptable use
You agree not to:
- Use the Service to violate any applicable law or any third-party right.
- Attempt to extract, scrape, or otherwise misappropriate other users' idea content, founder profiles, or any non-public data the Service surfaces.
- Attempt to circumvent quotas, authentication, rate limits, or the entitlement system, including by sharing API tokens beyond their issuing user.
- Submit content that infringes intellectual-property rights, contains malware, or that you have no right to submit.
- Re-sell or commercially redistribute Trigvale-generated reports as your own paid product without a written commercial agreement with sydacos GmbH.
- Reverse-engineer, decompile, or disassemble the Service except to the extent expressly permitted by mandatory law (§69d, §69e UrhG).
7. Your content and our use of it
You retain ownership of the ideas, founder-profile data, and other content you submit ("Your Content"). You grant sydacos GmbH a worldwide, non-exclusive, royalty-free licence to host, process, store, transmit, and display Your Content solely for the purpose of operating the Service for you and for the limited statistical analyses described below.
We may use anonymised, aggregated patterns derived from Your Content (for example archetype-cluster statistics that report "73% of ideas in this cluster under-specify their first 100 users") to improve the Service for everyone. These derivations cannot identify you or your specific ideas. We do not sell, share, or use Your Content to train third-party models. We do not use Your Content for advertising.
8. Live evidence and AI outputs
The Service queries public APIs (Reddit, GitHub, Hacker News, Stack Overflow, dev.to) and uses third-party LLM providers (Anthropic, OpenAI) to produce briefs, scores, sharpens, sprints, and recommendations. These outputs may be incorrect, incomplete, or outdated. You are solely responsible for evaluating any output before acting on it.
Live-evidence panels link to third-party sources whose content we do not control and for which we therefore accept no liability beyond the obligations described in our Imprint.
9. Service availability and changes
We aim for high availability but do not warrant uninterrupted operation. We may perform maintenance, deploy updates, or change feature behaviour at any time. For material changes that significantly degrade a paid feature we will give at least 30 days' notice and offer a pro-rated refund for the affected billing cycle if you cancel.
10. Termination
You may delete your account at any time from Settings. We may suspend or terminate your access for material breach of these Terms, including unpaid fees, suspected fraud, or repeated acceptable-use violations. Material breach unrelated to payment will be preceded, where reasonable, by a written warning identifying the breach and a reasonable period to cure. Upon termination, your data is deleted in accordance with the retention schedule in our Privacy Policy.
11. Warranties and statutory liability
To the extent permitted by mandatory consumer-protection law, the Service is provided as-is. We provide the Service with reasonable care and skill but make no specific warranties as to fitness for a particular purpose or uninterrupted operation beyond what is required by law.
Liability. sydacos GmbH is liable without limitation for damages caused by intent or gross negligence, for damages from injury to life, body, or health, and under the Product Liability Act (Produkthaftungsgesetz) and any mandatory statutory liability. For breaches of essential contractual obligations (so-called cardinal obligations — obligations the fulfilment of which is essential for the proper performance of the contract and on the observance of which the user may regularly rely) sydacos GmbH is liable for ordinary negligence only up to the foreseeable damage typical for this type of contract. Any further liability for ordinary negligence is excluded.
12. Indemnity
You agree to indemnify and hold sydacos GmbH harmless from any third-party claim arising out of (a) your breach of these Terms, (b) your violation of any law, or (c) your infringement of any third-party right through Your Content or your use of the Service. This clause does not apply to consumers within the meaning of §13 BGB to the extent prohibited by mandatory law.
13. Governing law and venue
These Terms are governed by the laws of the Federal Republic of Germany, excluding the conflict-of-laws rules and the UN Convention on Contracts for the International Sale of Goods (CISG). Mandatory consumer-protection laws of the consumer's country of habitual residence remain unaffected.
For business customers (Kaufleute) within the meaning of the German Commercial Code, the exclusive place of jurisdiction for disputes arising out of or in connection with the Service is Lübeck, Germany. Statutory exclusive places of jurisdiction remain unaffected.
14. Online dispute resolution (consumers)
The European Commission provides a platform for online dispute resolution at ec.europa.eu/consumers/odr. We are not obliged and not willing to participate in dispute-resolution procedures before a consumer-arbitration board.
15. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email at least 30 days before they take effect. If you do not accept the updated Terms you may terminate the contract before the effective date; continued use of the Service after the effective date constitutes acceptance.
16. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid provision that most closely approximates the commercial intent of the invalidated provision.
